Meza Hospitality Solutions Pty Ltd and our related bodies corporate (Meza, we, our, us) are committed to respecting your privacy. This Policy sets out our information management practices.

Please note that some of our services include links to services of third parties whose privacy practices differ from Meza’s. If you provide information to any of those services, your data is governed by their privacy policies.

Special Meaning of Certain Words in this Privacy Policy

app(s) means the Meza software applications.

hospitality venue means hospitality industry businesses (such as restaurants, bars, coffee shops, hotels, motels, etc.) that use the Meza hospitality venue app software and/or services.

information means personal information and sensitive information collected about an individual.

patron means a customer or potential customer of a hospitality venue that uses the Meza mobile app through which food and beverages can be ordered from his/her mobile phone.

personal information means information or an opinion, whether true or not and whether recorded in a material form or not, about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion and includes sensitive information as defined in the Privacy Act (which includes information relating to an individual’s health, sexual preference and racial or ethnic origin).

Privacy Act means the Privacy Act 1988 (Cth) of Australia.

sensitive information has the meaning given in the Privacy Act and includes information relating to an individual’s health, sexual preference and racial or ethnic origin.

site means mezapp.com (across desktop, mobile, tablet and apps and including any subdomains).

you/your are references to individuals who uses our services or site.

Amendments

This Privacy Policy may be updated from time to time. We will notify you of any material changes by posting the revised Privacy Policy on www.mezapp.com/legal-stuff. Consult this policy regularly for any changes.

This Privacy Policy is effective from 1 July 2015.

Information collected

In order for us to offer and supply certain services to you, we will need to collect certain information about you. The information we collect depends on the services and features you use. An example of sensitive information we may collect is any food allergies you may have. PLEASE NOTE THAT EACH HOSPITALITY VENUE WHERE YOU USE THE APP WILL HAVE DIRECT ACCESS TO ALL THE INFORMATION YOU PROVIDE BY USING THE APP. PLEASE REFER TO THE REGISTRATION BY PATRONS SECTION TO UNDERSTAND HOW HOSPITALITY VENUES CAN ACCESS YOUR INFORMATION IF YOU USE THE APP IN THEIR VENUE. BY USING THE APP, YOU THE PATRON, ARE REQUESTING AND AUTHORIZING MEZA TO PROVIDE YOUR INFORMATION TO THE HOSPITALITY VENUE(S) WHERE YOU USE THE APP AND YOU WILL THEREFORE ALSO HAVE TO CHECK THAT SPECIFIC HOSPITALITY VENUE’S PRIVACY POLICY TO FIND OUT HOW THEY COLLECT AND USE YOUR INFORMATION.

Meza requires that hospitality venues comply with the provisions of the Privacy Act and any other data protection legislation applicable in the jurisdiction where they operate. Notwithstanding the foregoing, THE USE OF YOUR INFORMATION BY THE HOSPITALITY VENUES IS NOT WITHIN THE CONTROL OF MEZA AND WE DO NOT ACCEPT RESPONSIBILITY FOR THEIR CONDUCT.

If you do not provide your information to us, we may be unable to supply some or all of our services to you. Meza reserves the right to clear all patron information from its site.

Registration by hospitality venues

Hospitality venues can subscribe to our software and services on www.mezapp.com.

Registration by patrons

Patrons can register to use our mobile phone app by downloading the app from the Apple app store or any other application store through which it is made available or with certain third party social networking sites (“SNS”) (including Facebook). If you decide to register through an SNS, we (and the hospitality venues where you use the app) will obtain the information you have provided to the SNS (such as your “real” name, profile picture, birth date and other information you make publicly available via the applicable SNS) from the account you have with such SNS. The information we obtain may depend on the privacy settings you have with the SNS. Each time that you are within a certain radius from a hospitality venue (generally 50 meters) that hospitality venue(s) may allow you to “check in” and order from its menu. If you do not wish to receive these notifications you can disable the notification function in which case you will also not be able to ‘check in’ or place an order by using the app.

Generally, you have no obligation to provide any information requested by us. If you choose to withhold requested information however, we may not be able to provide you with the services.

IMPORTANT NOTE: BY ‘CHECKING IN’ YOU ARE PROVIDING THE HOSPITALITY VENUE WITH ACCESS TO YOUR INFORMATION DISCLOSED WHEN YOU REGISTERED OR PROVIDED IN USING THE APP. THEREFORE, PLEASE ASK FOR A COPY OF THE HOSPITALITY VENUE’S PRIVACY POLICY AND CONSIDER IT BEFORE YOU DECIDE TO ‘CHECK IN’.

Use of information

We use information held about you for the following purposes:

  • to operate our business and provide (including improving and personalizing) the services we offer;
  • to give effect to transactions made using our services;
  • to understand our client’s (including hospitality venues and patrons) needs and personal preferences;
  • to inform you of changes and improvements to our services;
  • to provide you with information and send you emails about products or services that you request from us;
  • to allow you to participate in interactive features of our services, when you choose to do so;
  • to administer and manage our services and site(s) and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
  • to display advertising (some of our services are supported by advertising and we use the information collected to help us in selecting the ads we deliver);
  • to send emails, newsletters, advertisements and push notifications about information, material and services which we feel may interest you. Note: You may opt-out from receiving certain emails and certain or all push-notification, advertisements or newsletters.

Information we receive from other sources

We may combine information that you give to us and we collect from you with information we receive from other sources. We may use this combined information for the purposes set out above (depending on the type of information we receive).

IP Addresses Cookies and other technologies

Our web servers gather your IP address to assist with the diagnosis of problems or support issues with our services and to monitor the use of our services and site.

To improve your experience on our site, we may use ‘cookies’. A cookie is a small text file that our site may place on your computer or smart/mobile device as a tool to remember your preferences, for example your food orders. Our systems record a variety of information in relation to interactions with our online services. This can include information about software versions used, IP address, location data (where not disabled by the user), dates, times, file metadata, referring website, data entered and user activity such as links clicked.

You may refuse the use of cookies by selecting the appropriate settings on your browser. Note that if you do this you may not be able to use the full functionality of our services or site.

Our online services may contain links to other websites. We are not responsible for the privacy practices or policies of those websites and recommend that you review their privacy policies.

Disclosure of your information

As mentioned above, where you have ‘checked in’ to a hospitality venue it will have access to your information.

We may need to disclose information we hold about you to third parties, for example:

  • our service providers and contractors who assist us in our business and who make the provision of our services and products better. Examples of these types of service providers are information technology providers, auditors and consultancy firms;
  • other users of our products and services, in circumstances where it is necessary to do so for the proper functioning of the service;
  • if required by law and when we believe that disclosure is necessary in order to comply with any legal obligation, judicial proceeding, court order, legal process served on us;
  • to assist law enforcement agencies;
  • to enforce or apply our site, services and apps’ terms of use or other agreements;
  • to protect our rights, property, safety of our personnel, customers, users or others; This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction;
  • if we sell or buy any business or assets in which case we may disclose your information to the prospective seller or buyer of such business or assets;
  • if we, or a substantial percentage of our assets, are acquired by a third party and the information of the users of our services or apps is one of the transferred assets.

International transfer, storage and security of information in the cloud

Information collected by Meza may be stored and processed in Australia or any other country where Meza or its affiliates, subsidiaries or service providers maintain facilities.

Our service providers may be engaged in, among other things, the processing of your payment details, the provision of cloud services and the provision of security and other services.

We take reasonable steps to make sure that the information is processed and stored securely and according to the provisions of this privacy policy and the requirements of the applicable legislation. For example, with respect to users located in Australia using our services, where we transfer or disclose information to persons outside of Australia we believe that the recipients of such information are subject to a law, binding scheme or contract which effectively upholds principles for fair handling of the information that are similar in all material respects to the Australian Privacy Principles outlined in the Privacy Act.

No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your information it cannot be guaranteed. You must maintain the confidentiality of any password or accounts used on the site in order to keep information secure. Meza will not be held responsible for events arising from unauthorized use or access to your account or any other breach of security relating to your account. Information stored on your mobile device as part of the app is not controlled by Meza. It is your responsibility to ensure that the information is protected from loss or misuse.

Also refer to the Registration by Patrons section above with respect to information to which a hospitality venue has access when a patron ‘checks in’ by using the app.

YOUR PROVISION OF YOUR INFORMATION REPRESENTS YOUR AGREEMENT TO THE OVERSEAS TRANSFER, STORING AND PROCESSING OF YOUR INFORMATION AS SET OUT ABOVE.

Accessing and updating your information

The Privacy Act gives you the right to access information we hold about you. Your right of access can be exercised in accordance with the Privacy Act. Any access request will be subject to a fee to meet our costs in providing you with details of the information we hold about you.

Unless you are a registered patron, Meza does not collect information that identifies you personally.

If you need to access or correct any information we hold about you, please contact us at the email address below. We request that you provide us with as much detail as you can about the particular information you seek, in order to help us retrieve it. In certain circumstances, we may not be required by law to provide you with access or to correct your information. If that is the case, we will give you our reasons for that decision.

If you have any questions or feedback about privacy, wish to access or correct your information or wish to make a complaint about the way in which we have handled your information, please contact us at legal@mezapp.com. We may ask you to put your complaint in writing and to provide details about it. Any complaints received by us will be referred for prompt investigation by our compliance team and a response will be provided to you as soon as possible.
